3. Account Registration

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information, and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

Use the services for any unlawful, harmful, or fraudulent purpose
Send unsolicited messages (spam) through the platform
Interfere with or disrupt the services, servers, or networks
Attempt to gain unauthorized access to any part of the services
Reverse engineer, decompile, or disassemble any aspect of the platform

5. Intellectual Property

All content, features, and functionality of the BeTechky platform — including text, graphics, logos, icons, images, software, and design — are owned by or licensed to BeTechky and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from our services without our prior written consent.

6. User Content

You retain ownership of content you create or upload to the platform ("User Content"). By uploading User Content, you grant BeTechky a non-exclusive, worldwide, royalty-free license to use, store, and process it solely for the purpose of providing our services to you.

7. Payment Terms

Fees for services are as quoted or agreed upon at the time of purchase
Payments are due according to the billing cycle established at signup
All fees are non-refundable unless otherwise stated in writing
We reserve the right to modify pricing with 30 days' advance notice
Late payments may result in service suspension or termination

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience unforeseen outages. We are not liable for any losses arising from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, BeTechky shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your use of or inability to use the services
Unauthorized access to or alteration of your data
Any third-party conduct on the services
Any other matter relating to the services

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to BeTechky in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BeTechky, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the services or violation of these Terms.

11. Termination

Either party may terminate the agreement at any time with written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the services ceases, and we may delete your account data after a reasonable retention period.

12. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Winnipeg, Manitoba, Canada, in accordance with applicable arbitration rules. The laws of the Province of Manitoba and the federal laws of Canada applicable therein shall govern these Terms.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the services after modifications constitutes acceptance of the updated Terms. Material changes will be communicated via email or platform notification.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and BeTechky regarding your use of the services.
